The APGA Senate candidate for the Anambra South Senatorial seat come 2023 is yet to be determined. The matter is presently before the Federal High Court Suit No FHC/ABJ/CS/909/2022.
You will recall that following the primary result for the senate earlier this year; Hon Ben Nwankwo challenged the outcome of the result, which claimed that Chris Azubogu won. Dr. Nwankwo claimed that Azubogu did not resign his seat at the Federal House of Representatives. And that Azubogu did not properly resign from PDP to warrant his participation in the APGA primaries for the Senate seat.
Hon Nwankwo filed suit to that effect in the Federal high court Abuja. Nwankwo joined the APGA and INEC as co-defendants.
Emmanuel Chibuzor Nwachukwu participated in the APGA senate primaries against Chris Azubogu and Ben Nwankwo.
Nwachukwu faulted the participation of Ben Nwankwo on the grounds that he did not resign from the APGA Board of Trustees (BOT).
Nwachukwu, through his counsel, Hon Egwuoyibo Okoye (Esq), sought to join the suit filed by Nwankwo against Chris Azubogu to protest his interest.
The counsels for both Chris Azubogu and Ben Nwankwo, Onyechi Ikpeazu SAN and Ikwueto SAN vehemently opposed Nwachukwu from joinder in the case.
Following multiple authorities advanced by the two counsels in opposition to the joinder, the Judge, however, ruled that Nwachukwu has sufficient interest in the case to merit being joined.
The Judge subsequently ordered the counsels for Chris Azubogu and Ben Nwankwo to serve counsels for Nwachukwu, all processes filed in the matter within one week. Nwachukwu must respond as well.
The case has been adjourned to October 6th, 2022 for continuation.

But I am sincerely happy with the decision so far taken by the court, as Onodugo is a stakeholder in the matter having participated in the election. The case is like where charcoal is calling pot black. I pray for the team of judges to be guided by wisdom.
