The Court of Appeal sitting in Abuja has nullified the nomination of Uche Ogah as the governorship candidate of the All Progressives Congress (APC) for the 2023 governorship election in Abia.
A three-member panel of the Court of Appeal on Friday restored Ikechi Emenike as the duly elected governorship candidate of the party in the state.
A unanimous judgment by the panel led by Justice Olabisi Ige upheld the May 26, 2022, primary election of the party, which produced Emenike as valid.
The appellate court further nullified the judgment of the Federal High Court in Abuja declaring Ogah as the real candidate when the matter was already before the Court of Appeal.
But the Appellate Court in the judgments delivered one after the other on Appeal No. CA/ABJ/1258 High Chief Ikechi Emenike Vs Dr Sampson Uche Ogah & 3 Ors; CA/ABJ/1257 APC Vs Dr Sampson Uche Ogah & 3 Ors resolved the appeals in favour of the appellants.
It also held that appeal No. CA/ABJ/1297 filed by Dr Eke was successful, thereby dealing a crushing blow to Ogah’s claim to the Abia APC governorship ticket.
The appellate court had in September in a related matter upheld the findings of an Abia State High Court in Umuahia, which on June 24 upheld Emenike’s candidacy.
